Our Repro Equity Priorities

As we prepare to see hostile attacks from anti-abortion extremists in the federal government and a renewed effort to criminalize patients and providers, it is critical that the Massachusetts legislature act quickly to further protect those seeking and offering care, and expand access to abortion care throughout pregnancy.

Take a look at our priorities for the 2025-26 Legislative Session:

  • At no point in pregnancy is the government more qualified to make decisions about reproductive health care than a doctor and their patient. As Donald Trump continues to threaten abortion access and interstate travel nationwide, Massachusetts must update state law to expand access to abortion later in pregnancy and ensure no one must leave the state for abortion care.   • Every day, companies collect and sell sensitive personal location data from our cell phones, revealing where we work, live, seek medical care, and more. Anyone with a credit card can buy location information from data brokers — including anti-abortion extremists, politicians in restricted states, and other far-right groups across the country. As Donald Trump continues to threaten nationwide surveillance of pregnant people, our digital privacy is a serious reproductive equity issue. That’s why Reproductive Equity Now, along with our partners at the ACLU of Massachusetts, is supporting the Location Shield Act to prohibit the sale, lease, or trade of Massachusetts cell phone location data to protect patients and providers.   • The Massachusetts Legislature has taken bold action to break down cost barriers to care by eliminating cost-sharing for abortion. However, people on high deductible plans still face exorbitant out-of-pocket costs for the full spectrum of pregnancy care. Now, we must go further and enact An Act Ensuring Access to Full Spectrum Pregnancy Care, which would require health insurance plans to cover all pregnancy care—including prenatal care, childbirth, miscarriage management and postpartum care—without any kind of cost-sharing. Pregnant people should be the ones to dictate their own reproductive health care—not deductibles or insurance plans.

    Description: This legislation eliminates current statutory barriers requiring young people aged 15 or younger to obtain parental consent or a judicial bypass in order to seek abortion care.

    Description: This bill expands equitable access to abortion care in several ways including improving youth access, prohibiting targeted restrictions of abortion and abortion providers, and introducing a state level EMTALA to ensure emergency pregnancy complications are treated at hospitals.

    Description: The bill establishes a Midwifery Workforce Development Fund to support midwifery education and student loan forgiveness, ensures fair reimbursement rates for midwives, and addresses regulatory barriers to enhance birth center sustainability. It also creates a community birth data registry for Massachusetts to improve care quality. The goal is to strengthen the midwifery workforce and support sustainable birth centers.

    Description: This legislation increases transparency around which health plans are subject to state-mandated benefits, including the Contraceptive ACCESS Law, by requiring plans to note on member insurance cards whether members are enrolled in a fully-insured health plan.

    Description: This legislation protects against forced female sterilization, ensures Medicaid coverage for voluntary female sterilization, even when the patient has not met the federal 30-day waiting period, provided that they complete decision counseling regarding the sterilization and sign their written consent.
